No-fault divorce in New York

In 2010, New York State joined the rest of the country in allowing no-fault divorce. There is no longer any pressure to give fault grounds that explain your matrimonial problems. If your marriage “has broken down irretrievably for a period of at least six months,” you may file for divorce immediately — even if you still live together. No separation period is required. However, for a no-fault divorce without trial you must present an agreement showing the resolution of:

  • The equitable distribution of marital property
  • The payment or waiver of spousal support
  • The payment of child support
  • Payment of counsel and experts' fees and expenses
  • Custody and visitation with the minor children of the marriage

Our knowledgeable attorneys can help you put together a fair an equitable agreement that will be quickly accepted by a  Judge with minimal cost to the client. However, many cases cannot be resolved without the necessity of Court intervention. In those cases, we provide vigorous representation at trial by our exerienced Trial attorney's.

Equitable distribution of property

Our lawyers work to ensure that you get your fair share of the marital property during your divorce proceeding. New York divorce law allows you to keep your separate property, which includes:

  • Property acquired before the marriage
  • Inheritance
  • Gifts you received from someone other than your spouse
  • Certain compensation for personal injury cases
  • Property established as separate in a prenuptial agreement

All other property acquired during the marriage is understood to be marital property and is divided by the court. If you want to avoid a trial and can negotiate with your spouse, our experienced attorneys help you achieve a non-litigated solution though mediation or collaborative divorce.

Maintenance, alimony, or spousal support

Maintenance, also commonly known as alimony, is not an automatic part of divorce.  Maintenance may be awarded if one spouse can prove the need for it and the other spouse has the means to pay it. Maintenance can be awarded in family court as well, but it is referred to as spousal support. Our lawyers help you establish an alimony arrangement that is fair and reasonable under your particular financial circumstance.
