No-fault divorce in New York
In 2010, New York State joined the rest of the country in allowing no-fault divorce. There is no longer any pressure to give fault grounds that explain your matrimonial problems. If your marriage “has broken down irretrievably for a period of at least six months,” you may file for divorce immediately — even if you still live together. No separation period is required. However, for a no-fault divorce without trial you must present an agreement showing the resolution of:
- The equitable distribution of marital property
- The payment or waiver of spousal support
- The payment of child support
- Payment of counsel and experts' fees and expenses
- Custody and visitation with the minor children of the marriage
